15. Dispute Resolution

15.1. Informal Dispute Resolution

Before filing a claim, you and the Company agree to try to resolve the dispute informally. The party initiating the dispute must send written notice describing:

15.2. Agreement to Binding Arbitration

If a dispute cannot be resolved informally, it shall be resolved by final and binding arbitration, except as otherwise provided below.

Arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with:

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration agreement.

Judgment on the award may be entered in any court of competent jurisdiction.

15.3. Small Claims Court Option

Either party may bring an individual claim in small claims court in the county where the customer resides or in Maricopa County, Arizona, provided the claim qualifies and remains in small claims court.

15.4. Class Action Waiver

To the fullest extent permitted by law:

Disputes must be brought in an individual capacity only.
No party may participate in a class action, consolidated action, representative action, or private attorney general proceeding.
The arbitrator may not consolidate claims or preside over any form of class proceeding.

If this class action waiver is found unenforceable, the arbitration provision shall be null and void as to that proceeding only.

15.5. Governing Law

These Terms and any dispute arising from them shall be governed by the laws of the State of Arizona, without regard to its conflict of law principles, except to the extent preempted by federal law, including the Federal Arbitration Act.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Changes will be effective immediately upon posting to the Website. It is your responsibility to review these Terms periodically.

17. Miscellaneous
